Simones Tutoring FZE — Supplemental Terms

These Supplemental Terms (“Supplemental Terms”) apply to specific services, programs, products, promotions, and features offered by Simones Tutoring FZE (“Simones Tutoring,” “we,” “our,” or “us”). These Supplemental Terms are incorporated into and form part of the Simones Tutoring Terms of Service.

By using any applicable service, feature, or program governed by these Supplemental Terms, you agree to comply with them.

If there is a conflict between these Supplemental Terms and the general Terms of Service, these Supplemental Terms will control solely for the applicable service or feature.

1. Online Classes and Tutoring Sessions

a. Educational Services

Simones Tutoring provides access to online educational services, including but not limited to:

• Private tutoring;

• Group classes;

• Academic coaching;

• Exam preparation;

• Language instruction;

• Skill-building workshops;

• Mentorship programs;

• Enrichment activities.

Educational services are delivered by independent educators, tutors, instructors, or contractors (“Educators”).

Simones Tutoring does not guarantee:

• Academic outcomes;

• Grade improvements;

• Admission results;

• Certification results;

• Specific learning achievements.

Student success depends on multiple factors, including participation, attendance, effort, and external circumstances.

b. Scheduling and Attendance

Students and parents are responsible for:

• Attending scheduled sessions on time;

• Providing accurate contact information;

• Maintaining adequate internet access and devices;

• Ensuring students are prepared for sessions.

Late arrivals, missed sessions, or technical issues on the student’s side may reduce session time without refund eligibility.

Educators may refuse participation to disruptive attendees or students who violate platform rules.

c. Cancellations and Refunds

Cancellation and refund eligibility may vary depending on:

• The type of class or program;

• Subscription terms;

• Promotional offers;

• Instructor policies;

• Package structures.

Unless otherwise stated:

• Missed sessions are generally non-refundable;

• Refunds are issued at Simones Tutoring’s discretion;

• Repeated cancellations or abuse of refund policies may result in account restrictions.

Simones Tutoring reserves the right to issue credits instead of monetary refunds where appropriate.

2. Subscription Services

a. Automatic Renewals

Certain Simones Tutoring services may operate on recurring subscription plans.

By purchasing a subscription, you authorize recurring billing using your selected payment method until cancellation.

Subscriptions automatically renew unless canceled before the next billing cycle.

b. Subscription Changes

We reserve the right to:

• Modify subscription pricing;

• Discontinue subscription offerings.

Reasonable notice may be provided before material pricing changes where required by law.

c. Cancellation Policy

By participating in sessions, users consent to recording where legally permitted.

Users may not independently record sessions without obtaining all legally required permissions.

b. User Content

Students, parents, and educators retain ownership of content they create and upload.

By uploading or submitting content through Simones Tutoring, users grant Simones Tutoring a worldwide, non-exclusive, royalty-free license to:

• Host;

• Store;

• Reproduce;

• Display;

• Distribute;

• Modify for technical purposes;

• Use for platform operations and marketing.

Users represent that they own or have rights to all uploaded content.

5. Student Conduct

Students and parents agree not to:

• Disrupt classes;

• Harass educators or other students;

• Share inappropriate content;

• Use offensive or discriminatory language;

• Attempt unauthorized access to accounts or systems;

• Engage in cheating, impersonation, or fraudulent behavior.

Simones Tutoring may suspend or terminate accounts for conduct violations.

6. Technology Requirements

Users are responsible for maintaining:

• Internet connectivity;

• Compatible hardware and software;

• Updated browsers or applications;

• Functioning microphones, cameras, or required tools.

Simones Tutoring is not responsible for service interruptions caused by third-party internet providers, device failures, or external technical issues.

7. International Use

Users accessing Simones Tutoring from outside the United Arab Emirates are responsible for ensuring their use complies with local laws.

Certain services may not be available in all regions.

Users are solely responsible for any taxes, regulatory obligations, or restrictions applicable in their jurisdiction.

8. Payment Processing

Payments may be processed through third-party payment providers.

By making purchases, users agree to the applicable payment processor terms and authorize charges associated with their selected services.

Simones Tutoring is not responsible for payment processor outages, delays, or third-party system failures.

9. Intellectual Property

All Simones Tutoring branding, platform materials, software, graphics, designs, and proprietary content remain the exclusive property of Simones Tutoring FZE or its licensors.

Users may not:

• Copy platform materials without authorization;

• Reverse engineer platform technology;

• Use Simones Tutoring trademarks without permission;

• Reproduce educational content for commercial purposes.

10. Limitation of Liability

To the maximum extent permitted by law, Simones Tutoring FZE shall not be liable for:

• Indirect or consequential damages;

• Educational outcomes;

• Lost data;

• Lost profits;

• Service interruptions;

• Third-party conduct;

• Technical failures;

• Unauthorized account access.

Total liability shall not exceed the total amount paid by the user to Simones Tutoring during the six (6) months preceding the claim.

11. Indemnification

Users agree to indemnify and hold harmless Simones Tutoring FZE, its affiliates, employees, contractors, and partners from claims arising out of:

• Violation of these Supplemental Terms;

• User misconduct;

• Uploaded content;

• Intellectual property infringement;

• Violation of laws or regulations.

12. Governing Law

These Supplemental Terms are governed by the laws of the United Arab Emirates.

Any disputes shall be subject to the jurisdiction of the courts of Dubai, United Arab Emirates, unless otherwise required by applicable law.

13. Changes to These Supplemental Terms

Simones Tutoring may update or modify these Supplemental Terms at any time.

Updated versions become effective upon posting unless otherwise stated.

Continued use of the platform after updates constitutes acceptance of the revised terms.
